AHIMA Advocacy Summit 2019


AHIMA Advocacy Summit was March 25-26, 2019. We had the opportunity to hear from some key offices that directly impact our HIM profession. 

Day one highlights from the Summit include:

Timothy Noonan, Deputy Director, Health Information Privacy, HHS OCR, spoke about Improving Coordinated Care, Right of Access and Covered Entities. 

Initiatives OCR is reviewing:
  • Copies of records to patients - OCR is questioning if the timeframe to provide copies to patients with electronic records should be shortened from the current standard of 30 days since electronic records can be provided more quickly than paper.
  • Mental/Behavioral Health (MH/BH) –OCR recognizes reluctance to share MH/BH records and is looking at enhancing the sharing of MH/BH information.
  • Accounting of Disclosures – Treatment, Payment, Healthcare Operations (TPO) is not applicable under the HITECH Act.The OCR is now wondering if it’s feasible with many organizations using EHR’s.
  • Notice of Privacy Practices (NoPP) – Patients are asked to sign a document confirming they received a copy of NoPP; or if they refuse to sign, could lead to patient not receiving care.Since patients can receive NoPP in a variety of ways there is an RFI asking if this rule can be relaxed or eliminated to not hand out the NoPP.

Dr. Andrew Gettinger, Chief Clinical Officer, ONC for Health IT, discussed the 21st Century Cures Act.  Gettinger stated Title IV-Delivery final report is estimated to be released summer 2019 which embeds changes with CMS and ONC.  Gettinger also mentioned the comment period is now open on the Proposed Rules of §4001 – §4006.  This includes items such as information blocking, scope of Electronic Health Information (EHI), patient access, and transition between health IT systems.  Comments must be submitted by May 3, 2019.
