WHIMA 2020 Annual Conference – Frequently Asked Questions

While the in-person WHIMA 2020 Annual Conference has been cancelled, WHIMA is committed to providing our membership opportunities for education and learning.  WHIMA will provide you the same expert content just in a more flexible, virtual format. This will include recordings of the keynote session, general sessions – as well as many of the breakout sessions – to watch at your convenience in the safety, coronavirus-free environment of your work or home.

Coronavirus Aid, Relief, and Economic Security (CARES) Act 

Changes to 42 CFR Part 2 Substance Use Disorder records

In Section 3221 of the CARES Act (see link below), substance use disorder (SUD) records may be used or disclosed upon the written consent of the patient.  The SUD records may be used or disclosed by a HIPAA covered entity, business associate, or a SUD program for purposes of treatment, payment, and health care operations as permitted by the HIPAA regulations.

Any SUD information disclosed may then be redisclosed in accordance with the HIPAA regulations. 

It shall be permissible for a patient’s prior written consent to be given once for all such future uses or disclosures for purposes of treatment, payment, and health care operations, until such time as the patient revokes such consent in writing.

SUD patients have the right to request a restriction on the use or disclosure of a record for treatment, payment, or health care operations.  Covered entities should make every reasonable effort to the extent feasible to comply with a patient’s request for a restriction regarding such use or disclosure.

By March 2021, the Department of Health and Human Services, will be updating 45 CFR 164.520 addressing the HIPAA Notice of Privacy Practice, the covered entities creating or maintaining SUD records will need to provide notice, written in plain language, of privacy practices regarding patient records.

AHIMA Foundation
  • Through its Health Information Relief Operation (HIRO) Fund, the AHIMA Foundation is offering assistance to AHIMA members in FEMA disaster areas. Individuals may be eligible for assistance up to $500 if: 

    • You were a registered active member before the disaster was declared AND

    • You lived or worked in the FEMA disaster area for the last twelve months AND

    • You are unemployed

To make sure the most vulnerable members of the AHIMA family receive needed HIRO Fund support and apprentices can continue their education, we need to raise $750,000 by June 30. Will you contribute a recurring gift of one hour’s salary to support AHIMA members affected by the COVID-19 pandemic?
