| | | | | | MNHIMA Legislative Update |
| Did you know? Changes to legislation impacting release of health records: In April, the HIPAA Privacy Rule to Support Reproductive Health Care Privacy was issued by HHS. Effective December 23rd, 2024, regulated entities will need to obtain a signed attestation from certain types of requesters in order to disclose any PHI potentially related to reproductive health care. The attestation will be signed by the requester indicating that the use or disclosure is not for a prohibited purpose. See Fact Sheet.

| | | | While reviewing the information below, if you have any questions or would like to provide feedback to the Delegates attending the AHIMA House of Delegates on October 27th, please email this information to Sue Nathe, executivedirector@mnhima.org.
The below summary details proposed amendments to the AHIMA bylaws, sparking discussions and questions about their implications. These amendments touch on various aspects of the organization's governance, membership, and operations.
Key Proposed Bylaw Changes: AHIMA Mission Statement, Board of Directors Powers and Duties, and House of Delegates Purpose: This cluster of amendments, submitted by a group of past presidents, seeks to redefine AHIMA's mission, emphasizing its role as a professional membership organization dedicated to benefiting its members, advocating for their interests, and advancement of the profession and the integrity of health information. It also proposes changes to the Board of Directors' powers and duties and the House of Delegates' purpose to align with the revised mission statement. This change aims to clarify AHIMA's focus on serving its members and championing their professional needs. Nominating Committee: The proposed amendment revises the number of Nominating Committee members from nine to seven and clarifies the eligibility criteria for candidates, requiring them to be professional members who are AHIMA certified or credentialed. It also addresses the CEO's role in relation to the committee and emphasizes the importance of having a ballot representative of the membership. Dues Payment to Component Associations: This amendment proposes an increase in Dues payment to component associations from 20% to 26%, prompting questions about its potential impact on membership costs and the need for a financial review. This change aims to provide more financial support to CAs, enabling them to better serve their members and fulfill their missions. Past Speaker Role: This amendment introduces a new "Past Speaker" role to the House, extending the Speaker's involvement to three years and outlining their responsibilities as a mentor, advisor, and monitor House of Delegates initiatives. They could also run for an at-large board position while serving as past speaker. Professional Ethics Committee: This new amendment proposes changes to the criteria for disciplinary action by the Professional Ethics Committee. The amendment proposes modifying the language regarding actions that may result in disciplinary measures, focusing on standards for maintaining certification and actions that reflect unfavorably upon the profession. Combining the Finance and Audit Committees: This existing proposal from last year is being reconsidered. It suggests merging the Finance and Audit Committees into a single committee to streamline operations and optimize volunteer resources. Election and Term of Office: Also reconsidered from last year, this amendment proposes allowing board directors to serve a second term, addressing concerns about continuity and succession planning while incorporating a thorough vetting process by the Nominating Committee, member input and election to the position.
These proposed bylaw changes reflect AHIMA's ongoing efforts to adapt its governance structure, enhance member engagement, and ensure the organization's continued success in fulfilling its mission. These proposals are currently under review, with some referred to external legal counsel for further evaluation. The House of Delegates will ultimately vote on these amendments during their annual meeting in October, following discussions and feedback from members and component associations. The meeting emphasized the importance of transparency, open communication, and adherence to proper governance procedures in the decision-making process. |
