Governor Signs Agency Bills
The Governor has signed SB 140 and SB 141. Both pieces of legislation become effective
January 1, 2010. The Governor has also signed the Agency’s budget bills
(HB 5045 and HB 5046) for 2009-2011. HB 5046 raises the fee
for a background check to $47 (see related article below)

HB 5046 Raises Background Check Fee to $47
During this legislative session, HB 5046 increased the criminal background check fee to $47
effective July 1, 2009. Per ORS 181.533(9)(b) and OAR 863-005-0090, the Agency is allowed to charge background
check fees in amounts not to exceed the actual costs of acquiring and furnishing
criminal offender information. The Oregon State Police currently charges the Agency
$47.25 per background check, so it has become necessary to bring the fees closer

Agency Gears Up for Rulemaking
Along with the Agency bills, two other bills (HB 2910 and SB 640) require the Agency to write and adopt rules.
The legislation allows sole practitioners to become principal brokers and changes
the continuing education approval process. The Agency will be using the collaborative
process established when we undertook the major task of rewriting our administrative
rules two years ago. We will be requesting participation in the rule work groups
soon. We hope to have participants from the industry, associations, the Real Estate
Board and Agency staff committed to this process. The time commitment for actual
work group meetings should be much less than when the Agency undertook the intense
rule review of the licensing, property management and escrow administrative rules
that were effective January 1, 2009.

How To Inactivate a License
There are two ways to inactivate your own license or the license of a broker working
for you: (1) Mail the original license to the Agency at 1177 Center Street NE, Salem
OR 97301. A form or letter is not needed; OR (2) Print out and complete the “Inactive License” form from our website. Fax or mail the form to the Agency. A fee is not required
to inactivate a license. If you have any questions, please call the Licensing Division

Personnel Changes
Stacey Harrison who has been working in Land Development since December 2008 has
been appointed the Agency’s Education Manager. LeRoy Helton, who joined the Agency
last August as a temporary Information Systems Specialist, was appointed permanent
this month.
