Agency Rulemaking

Gene BentleyThe Agency is required to write rules for SB 140 and SB 141and HB 2910 passed during the 2009 Legislative Session. The legislation requires the Agency to change the licenses of all individuals licensed as sole practitioners on December 31, 2009, to principal broker licenses with no additional requirements of licensees. As of January 1, 2010, a sole practitioner license will not exist. The legislation provides that all licensees will self-certify their continuing education and also requires the Agency to write rules for licensing escrow agents. The Agency will use the collaborative process for rulemaking that was established two years ago during our rule review. Two work groups will be formed, one to work on rules that apply to brokers and property managers and one for escrow licensing. Participants will come from the industry, associations, the Real Estate Board and Agency staff. The tentative time line shows plans for one or two work group meetings for each work group.

Work will likely begin about September 10, 2009, on rules for SB 640 on changes to continuing education requirements. These rules are not due to be in effect until January 1, 2011.

Hearing Notice Filed

A hearing notice was published July 1 for proposed rule changes resulting from SB 140, SB 141 and HB 2910. The hearing is scheduled for 10 a.m., November 16, 2009, at the Agency’s office in Salem. The new rules are to be effective January 1, 2010. You may view the notice on our website

August Board Meeting

The Real Estate Board will meet at 10 a.m. August 3, 2009, at the Multnomah Athletic Club, 1849 SW Salmon Street, Portland. Hosts are the Portland Metropolitan Association of Realtors®. Watch the Agency’s website for the agenda.

Idaho Reciprocal Agreement Terminated

The reciprocal agreement between Idaho and Oregon was terminated as of June 30, 2009.  Current Idaho reciprocal licensees will be allowed to retain their licenses until their expiration date, at which point they must exchange them for a regular Oregon license.  If you have any questions regarding reciprocal agreements, please contact the Licensing Division at (503) 378-4170, selection 2.

Reminder About Free Customer Parking at the Agency

Five parking spaces directly in front of the Agency office are designated as free 30-minute parking spaces while conducting business at the Agency.  You no longer have to park at a metered space on the street while visiting our office for short periods of time.  The spaces are prominently signed and painted for your convenience.
